BEME TERMS AND CONDITIONS

Welcome to the Beme Web Site. Beme provides this Site as a service to you, our customers. Please review the following basic rules that govern your use of our Site. Please note that your use of our Site constitutes your agreement to follow and be bound by these terms. If you do not agree to these terms, please do not use this Site.


DEFINITIONS

“Conditions” means these terms and conditions;

“Contract/Agreement" means the contract incorporating these Conditions which is formed when You place an Order and We confirm acceptance of such Order;

“International” means countries other than Australia;

“Transactions/Order” means an order placed by You via this Website for one or more Products;

“Personal Information” means all and any information provided by You in an Order or when registering on any part of this Website to include without limit your name, address and card details;

“Product” means any product advertised on this Website;

“We/Us/Our” means Beme, Mosaic Brands Ltd, Ground Floor, 61 Dunning Avenue, Rosebery NSW, 2018

“Website/site” means BEME.com.au which is operated by Us;

“You/Your” means a user of this Website.

Unless we expressly provide otherwise, all Transactions, all Products and your use of such Products are subject to these Terms, which shall apply regardless of how you access the Site.  

Although you may "bookmark" a particular portion of this Site and thereby bypass this Agreement, your use of this Site still binds you to the terms. We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Your use of this Site following any such changes constitutes your agreement to follow and be bound by the Terms and Conditions as changed. For this reason, we encourage you to review these Terms and Conditions whenever you use this Site.


1. PRIVACY POLICY

Our privacy policy, which sets out how we will use your information, can be found at Privacy Policy. By using this Website, you consent to the processing described therein and warrant that all data provided by you is accurate.


2. TERMS OF SALE 

By placing an Order you are offering to purchase a product on and subject to the following terms and conditions. All Orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or forces outside of our control for which we will not be responsible.

In order to contract with Us you must be over 18 years of age and possess a valid credit card issued by a bank acceptable to us. We retain the right to refuse any request made by you. If your Order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be Us or may in some cases be a third party. Where a contract is made with a third party We are not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an Order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit card or an authorised user of the PayPal, Afterpay or Zippay account used to place your Order and that there are sufficient funds to cover the cost of the goods. All prices advertised are subject to changes.  

We may reject or cancel an Order for any reason prior to or after our acceptance of a Transaction.


A. OUR CONTRACT

When you place an Order, you will receive an acknowledgement e-mail confirming receipt of your Order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit card or withdrawn the funds from your PayPal, AfterPay or Zippay account.  


B. PRICING AND AVAILABILITY

Whilst we try and ensure that all details, descriptions and prices which appear on this Site are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you we will treat the Order as cancelled. If you cancel and you have already paid for the goods, but not received them, you will receive a full refund. Prices are inclusive of GST. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.


C. COLOURS

We have done our best to display as accurately as possible the colours of the products shown on the Site. However, because the colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.


D. PAYMENT

Upon receiving your order we carry out a standard pre-authorisation check on your credit card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your credit card will be debited once the order has been accepted.


E. PROMOTIONAL CODES

We may from time to time offer promotional codes which may apply in respect of any, or certain specified, purchases made though this Website. The conditions of use relating to any promotional code will be specified at the time of issue. These Terms & Conditions relate to all promotions, competitions and promotional codes (unless otherwise stated).

1. Promotional codes cannot be redeemed for cash.

2. An individual promotional code can only be used once per order.

3. Promotional codes will not be resupplied if lost or stolen.

4. The value of a promotional code will not be refunded if purchased items are returned.

5. A promotion code can't be used after an order has been placed.


F. CANCELLING YOUR PURCHASE

You have a right to request a refund for your purchase of Product(s) from the Site within 30 days of purchase and receive a refund if request is in line with our Returns Policy. Once an order is placed, you are unable to cancel it. To exercise your right to a refund, you may (i) return your Product to us using the returns form within 30 days of purchase (postage costs apply), or (ii) return your Product(s) to your local store within 30 days of the date identified on the invoice docket supplied with your order. This process excludes all Final Sale products and Third Party products, these items are identified at purchase as well as on the receipt.   In the event that we do not receive your returned Product(s) within thirty (30) days of the latter of (i) the date you notified us of your return and (ii) the date you received your Product(s), the deemed date of receipt will be the date of the post-mark on the packaging of your returned Product(s). We will not be responsible for the costs of such return.


G. FAULTY PRODUCTS

In the event that you receive a faulty Product, we recommend that as soon as you discover a fault, or if you received an incorrect item, please use the Contact Us form and send us a picture of the item and include a brief description of the fault. Once assessed and approved by our team or Third Party Seller, and if it is within six months from the purchase date, we will refund you back to the original tender type. Items deemed as general wear and tear and not due to a manufacturing fault will not be refunded.

We will not be liable to you for failures, defects or delays in delivery caused by:

• Your provision of incorrect or outdated information;

• Your mailbox being full;

• Your failure to comply with instructions for use of the Site; or

• Any event which is outside of our reasonable control.   


H. THIRD PARTY SELLERS

Third Party Seller products from Third Party Sellers are supplied to customers direct from the Third Party Seller warehouse. Third Party Seller products are available exclusively for Australian customers and are subject to Australian Customs and Duties charges upon delivery. Third Party Sellers products are excluded from all general site-wide promotional activity, including Reward Vouchers and do not contribute to your Membership seasonal rebate spend, unless and only if there is a specific promotional offer on the Third Party Seller product.


MISUSE OF THE SITE

You must not misuse this Website. You will not: commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Breaching this provision would constitute a criminal offence under the Cybercrime Act 2001. We will report any such breach to the relevant law enforcement authorities and disclose your identity to them.   We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

In an attempt to provide increased value to our visitors, We may choose various third-party web sites to link to from this Site. However, even if the third party is affiliated with Us, We have no control over these linked sites, all of which have separate privacy and data collection practices, independent of Us. We have no responsibility or liability for these independent policies or actions and We are not responsible for the privacy practices or the content of such web sites. These linked sites are only for your convenience and therefore you access them at your own risk. None the less, We seek to protect the integrity of Our Website and the links placed upon it and therefore request any feedback on not only our Site, but for sites we link to as well (including if a specific link does not work).

The content of the Site, and the Site as a whole, are intended solely for the personal, non-commercial use by the users of this Site. You may download, print or store selected portions of the content, provided you (1) only use these materials for your own personal, non-commercial use, (2) do not copy or post the content on any network computer or broadcast the content in any media, and (3) do not modify or alter the content in any way, or delete or change any copyright or trademark notice.  

No right, title or interest in any content or materials is transferred to You as a result of any such activities. We reserve complete title and full intellectual property rights in any content you download, reproduce, print, redistribute or store from this Site.  

Beme is a registered trademark. Except as noted above, you may not copy, download, reproduce, modify, publish, redistribute, retransmit, publicly display, publicly perform or create derivative works from the content without first obtaining written permission from Us.


MY ACCOUNT & WISHLIST

You are responsible for maintaining the confidentiality of the password chosen by You when You register on the Website and for restricting access to your computer and/or email address to prevent unauthorised access to your account. We reserves the right to close an account if any user is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple accounts, or disrupts any of our services in any way.   We reserve the right to delete Your account or wishlist at anytime. In this instance Your information will not be saved and cannot be retrieved by Us.


USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

All comments, feedback, reviews, suggestions, ideas, and other submissions disclosed, submitted or offered to Us on or by this Site or otherwise disclosed, submitted or offered in connection with your use of this Site (collectively, the "Comments") shall be and remain Our property. The above Terms and Conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between You and Us. Any waiver of any provision of the Terms and Conditions will be effective only if in writing and signed by a Director of Mosaic Brands Ltd.

TRANSACTION TERMS

The following terms and conditions (the "Transaction Terms") govern all Products (as defined below) and all Transactions (as defined below) in connection with this site (the "Site"). These Transaction Terms hereby incorporate the terms and conditions of the Terms of Use applicable to this Site. Unless we expressly provide otherwise, all Transactions, all Products and your use of such Products are subject to these Transaction Terms, which shall apply.


1. PRODUCTS

All rights in any products that we make available through the Site, such as music, images, video, artwork, text and other copyrightable materials (collectively, the "Products") are owned by us, our Affiliates and/or our (or their) licensors. Subject to your compliance with the terms and conditions of these Transaction Terms and any other applicable terms and conditions imposed by us, our Affiliates and/or our licensors, you have a limited, revocable right to use those Products that you purchase or access through the Site solely for your personal, non-commercial use in accordance with the terms and conditions of these Transaction Terms and any other terms and conditions that may apply to such Products, which right you cannot transfer to others. You understand that the Site and the Products include and/or rely on a security framework using technology that protects digital information and imposes usage rules established by us, our Affiliates and our (or their) licensors, and you hereby agree to abide by such usage rules.


2. PURCHASES

If you wish to purchase any Products made available through the Site (each such purchase, a "Transaction"), you may be asked to supply certain information in connection with such Transaction, including without limitation your credit card number or other payment account number, your billing address, and your shipping information. BY INITIATING A TRANSACTION, YOU REPRESENT AND WARRANT THAT YOU (A) ARE OF LEGAL AGE TO FORM A BINDING CONTRACT WITH US AND (B) HAVE THE LEGAL RIGHT TO USE THE PAYMENT MEANS SELECTED BY YOU. By submitting such information, you grant us the right to use such information in accordance with our Privacy Policy, including, without limitation, by providing such information to third parties for purposes of facilitating the completion of Transactions initiated by you or on your behalf. Verification of information may be required prior to the acknowledgement or completion of any Transaction.


HOW DO I USE THE SHOP

  • Choose the relevant item that you wish to purchase and click the 'Add To Shopping Bag' button to put the item into bag.
  • You will then be taken to the 'Shopping Bag' where you can edit the items and check that everything is correct. Once you have checked your basket, click the ‘Checkout' button.
  • At this point you will be required to log in as a returning customer, log in as a VIP Program Member, register to become a new member, or proceed as a guest. As a returning customer, you can log in where your details will have been saved from previous transactions.
  • You will then enter Billing and Delivery Information, filling out the required fields as a minimum. Once all the Billing and Delivery Information has been in-putted, you will need to select a payment method. Once a payment method has been selected then fill in all of the required fields as a minimum.
  • Once all the details have been filled in you will be able to review your order plus add a gift card or promotional code.
  • Once the order has been confirmed you can click on the ‘Pay Now’ button where your payment card details will be submitted to our payment services provider for secure processing. Once your payment has been securely processed, you will receive a confirmation email of your order.

Your initiation of a Transaction represents an offer to us to make a purchase, which offer is accepted by us only when your payment method has been debited in full settlement of the Transaction. We may reject or cancel any Transaction for any reason prior to or after our acceptance of such Transaction. Descriptions and images of, and references to, Products on the Site do not imply our endorsement of such Products.

Except to the extent prohibited by applicable law, we reserve the right, with or without prior notice, to change such descriptions, images, and references; to limit the available quantity of any Product; to honour, or impose conditions on the honouring of, any coupon, coupon code, promotional code or other similar promotions; to bar any user from making any or all Transaction(s); to refuse to provide any user with any Product; and/or to refuse or cancel any Transaction for any reason prior to or after our acceptance of such Transaction pursuant to this Section 2. Price and availability of any Product offered through the Site are subject to change without notice. If applicable, Product prices on the Site will be inclusive of GST unless we expressly provide otherwise. In the event that a Product is listed at an incorrect price or with other incorrect information, we have the right to refuse or cancel any Transaction for such Product at any point prior to or after our acceptance of such Transaction pursuant to this Section 2. You shall pay all charges that may be incurred by you or on your behalf through the Site, at the price(s) in effect when such charges are incurred, including without limitation all shipping and handling charges. In addition, you remain responsible for any taxes (including, if applicable, GST and/or any import duties) that may be applicable to your Transaction(s). Except to the extent applicable law provides otherwise, all sales through the Site are final, and all charges from those sales are non-refundable, except as otherwise expressly set forth in these Transaction Terms. We or our third party designees may automatically process charges against your selected payment method on the receipt page. We or our third party designees will inform you if all or any portion of your order is cancelled or if additional or different information is required to accept your order.


3. PRODUCT DELIVERY

Except to the extent prohibited by applicable law, we reserve the right to change Product delivery options without notice. On occasion, technical and other problems may delay or prevent delivery of a particular Product. Except to the extent that applicable law provides otherwise, your sole and exclusive remedy with respect to any Product that is not delivered within a reasonable period will be either replacement of such Product or a refund of the purchase price paid for such Product, as determined by us in our sole discretion. We will endeavour to process Transaction(s) within seventy-two (72) business hours from our receipt of payment. If we anticipate a delay in delivering a Product to you, we will seek to notify you by email of the estimated delivery date(s). If we are unable to completely fulfil your order we will notify you and refund you for the unfulfilled item.


4. CANCELLING YOUR PURCHASE

Purchasing Third Party Partners products from Beme Third Party Partners supplies Beme customers with products direct from their warehouse. Third Party Partners products on Beme are available exclusively for Australian customers, and are subject to Australian Customs and Duties charges upon delivery. Please Note: Third Party Partners products on Beme are excluded from all promotional activity and do not contribute to your seasonal rebate spend.

 

Shipping and Delivery

  • Third Party Partners products are subject to the same great Shipping and Delivery services as our other Beme Online items, there are just a few details to note; 
  • You will still receive Free delivery when you spend $120 online and delivery within Australia for purchases under $120 will attract a $10 flat fee
  • Third Party Partners products will be shipped separately. If you have purchased a mix of Third Party Partners and Beme items, you will receive 2 parcels (at no extra charge of course)
  • Third Party Partners orders over $1000AUD may incur customs charges and duties charged by the AU Customs Service once the parcel reaches its destination port and must be paid by the recipient directly to the AU Customs Service or its authorized service provider.
  • Your parcel will be dispatched within 5-7 business days (excluding weekends and public holidays) from the day you have placed your order. Delivery may take longer in remote or rural areas or during promotion and sale periods.
  • Third party products are excluded from Click & Collect.

 

Click & Collect

Click & Collect is a free service for all our customers. You only have to pay for the items you purchase.

  • Unfortunately, if not all items in your order are available at the store, your whole order will be sent to your home address from our warehouse.
  • Even if not all items in your order are available at the store, and your whole order is sent to your home address from our warehouse, we will still not charge you for delivery.
  • If you place your order before 3pm, your order will be ready to be picked up that same day! We’ll send you an SMS when your order is ready.
  • Please Note: During sale and promotional periods Click & Collect may be temporarily unavailable or take longer to get ready.
  • Third party products are also excluded from this service.

Returns

You are welcome to return your Third Party Partners product to online for a full refund (excluding any delivery charges) within 30 days from the date you received your order, all you need to do is fill in your returns form and use one of the below options.

Please allow up to 15 working days for your return to be processed.

Products can be refunded if the item is unworn, in its original condition with tags attached and there is proof of purchase. The products will be inspected upon return and if in less than perfect condition, we may return the product/s to you. The exception to this is earrings, due to health and safety reasons, in which case a refund will not be given. Swimwear & Lingerie can only be refunded if it is unworn with the tags and hygiene strip still attached.

Incorrect Items or Faulty Goods: We will do everything we can to sort out issues with faulty items straight away. As soon as you discover a fault, phone our friendly Customer Care team on 1300 728 980. Have handy your order number and from here we will arrange for the faulty item to be returned. Once we receive the item back we will be in contact to let you know next steps. If we are sending you a replacement item, we will do so as quickly as we can.

Please Note:

  • As Third Party Partners products are available exclusively online we cannot accept in store returns.
  • Do not send your product directly to the manufacturer. All items purchase on Beme are to be returned back to our online warehouse.

Collection Notice


Beme (Mosaic Brands Ltd) collects your personal information (including name, phone number, email address and membership details) when you enter this promotion for the purposes of administering the promotion. If we do not collect your personal information you will not be able to enter this promotion or claim your prize. We may disclose this information to third parties such as local lottery authorities and service providers assisting us with administering this promotion, for the purpose of conducting this promotion, including prize notification and fulfilment.

Conditions of Entry

 

1. Participation in this promotion is deemed acceptance of these terms and conditions.

2. Participation in this promotion is deemed acceptance of the general Beme (Mosaic Brands Ltd) Terms & Conditions which may be viewed at https://www.beme.com.au/terms-conditions.

3. The Promoter is Beme (Mosaic Brands Ltd) located at Ground Floor, 61 Dunning Avenue Rosebery NSW 2018.

4. This competition is open to all residents of Australia over the age of 18 years. Directors, management, employees, officers and contractors (and their immediate families) of the Promoter or of the agencies or companies associated with this promotion are ineligible to enter. Participants under the age of 18 must first seek permission from their parent or legal guardian to enter, and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions.

5. The competition commences at 5.30pm (AEDT) on Wednesday 14th April 2021 and concludes at 11:59pm (AEDT) on Thursday 22nd April 2021 (Promotional Period).


How to Enter

To enter the draw to win a $500 gift voucher, follow Beme’s account @bemestyle, answer the question: What would you like to thank your Mum for? Tag 3 friends (they must be following Beme) and like the promotional post.


Winning Determination


The winner for the Prize will be drawn at random at the office of Beme (Mosaic Brands Ltd) located at Ground Floor, 61 Dunning Avenue Rosebery NSW 2018 at 9am (AEDT) on Friday 23rd April 2021. The winner will be notified via direct message through the Instagram application. Beme (Mosaic Brands Ltd) reserves the right to feature the names of prize winners publicly. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. If the prize is not claimed by 5pm (AEDT) on Thursday 29th April 2021 the winner’s entry will be deemed invalid and the Promoter reserves the right to conduct further draws at 9am (AEDT) on Friday 30th April 2021 at the same location as the original judging as are necessary to distribute the prizes. In this event, no compensation will be given by Beme (Mosaic Brands Ltd) to the original winner. If any redrawn prize is not claimed by 5pm AEDT Friday 7th May 2021 the prize will be forfeited. The Promoter’s decision is final and no correspondence will be entered into.

Customers can elect to discontinue communications from Beme (Mosaic Brands Ltd) at any time. If a winner of a prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf. Entries are deemed to have been received by Beme (Mosaic Brands Ltd) when received by Beme’s (Mosaic Brands Ltd) software system, not when submitted by the entrant's computer.
